Welcome to Pupganics. These Terms of Service govern your access to and use of our website, products, and services. By accessing our website or using our services, you agree to be bound by these terms. If you do not agree with any part of these terms, please do not use our website or services.

OVERVIEW

This website is operated by Pupganics (AMS Industries LLC). Throughout the site, "we", "us", and "our" refer to Pupganics. Pupganics offers this website, including all information, tools, and services available from it, to you the user, conditioned on your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site or purchasing from us, you engage in our "Service" and agree to be bound by these Terms of Service, including the additional terms and policies referenced in them. These Terms apply to all users of the site, including browsers, customers, and contributors of content.

Our store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell our products to you.

SECTION 1 — ONLINE STORE TERMS

SECTION 3 — SUBSCRIPTION TERMS

Pupganics offers subscription purchasing for certain products. By enrolling in a subscription, you agree to the following:

  • Recurring Billing. You give your express affirmative consent for Pupganics to charge your payment method on a recurring basis at the frequency you selected at checkout. Your subscription renews automatically until cancelled.
  • Renewal Reminders. We send a reminder email at least 3 days before each renewal charge, stating the renewal date, the amount, and how to cancel.
  • Cancellation. You may cancel your subscription at any time through your account portal at Pupganics.com, which takes effect immediately, or by emailing help@pupganics.com at least 24 hours before your next renewal date. If a renewal has already been charged and shipped, your cancellation applies to the next billing cycle. Shipped subscription orders are not refundable, except as covered by the 90-Day Satisfaction Guarantee in our Refund Policy.
  • Modifications. You may change your subscription product, quantity, or frequency at any time through your account portal before your next renewal date.
  • Price Changes. We reserve the right to change subscription pricing. We will notify you by email at least 14 days before any price change takes effect. Your continued subscription after the effective date is acceptance of the new price.
  • Failed Payments. If your payment method fails, we will retry the charge. If payment cannot be collected, your subscription may be paused or cancelled.

SECTION 4 — ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We are not responsible if information on this site is not accurate, complete, or current. The material on this site is provided for general information only. We reserve the right to modify the contents of this site at any time.

SECTION 5 — MODIFICATIONS TO THE SERVICE AND PRICES

Prices for our products are subject to change without notice, except for subscription price changes, which follow the notice period in Section 3. We reserve the right to modify or discontinue the Service at any time without notice. We are not liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service.

SECTION 6 — PRODUCTS AND SERVICES

Certain products may be available exclusively online. These products are subject to return or exchange only according to our Return and Refund Policy at Pupganics.com/policies/refund-policy.

You represent and warrant that you are buying products from Pupganics for your own personal or household use, and not for resale or export. You agree to comply with all applicable laws and regulations. Pupganics reserves the right to cancel orders that appear to be placed for resale or commercial distribution.

We reserve the right to limit sales of our products to any person, geographic region, or jurisdiction on a case-by-case basis, and to discontinue any product at any time.

Pet Supplement Disclaimer: Pupganics products are intended for supplemental use in dogs only. These statements have not been evaluated by the U.S. Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease or health condition in animals. Consult your veterinarian before use, especially if your pet has a known medical condition or is under veterinary supervision.

SECTION 7 — ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. You agree to provide current, complete, and accurate purchase and account information for all purchases. You agree to promptly update your account information, including your email address and payment details, so we can complete your transactions and contact you as needed.

We may provide access to third-party tools that we neither monitor nor control. Any use of optional tools offered through the site is entirely at your own risk and discretion.

In no case shall Pupganics (AMS Industries LLC), our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including lost profits, lost revenue, lost savings, loss of data, or replacement costs, arising from your use of the Service or any products procured using the Service. Because some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such jurisdictions our liability shall be limited to the maximum extent permitted by law.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including the statutory rights of consumers in the European Union and United Kingdom.

SECTION 15 — INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Pupganics (AMS Industries LLC) and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party arising out of your breach of these Terms of Service or your violation of any law or the rights of a third party.

SECTION 16 — INTERNATIONAL ORDERS

For orders shipped outside the United States, the following additional terms apply:

  • Duties and Taxes: Whether duties and taxes are included at checkout depends on your country. See our Refund Policy for the current list of DDP and DDU countries.
  • Delivery time estimates for international orders are based on averages and are not guaranteed. Actual delivery times may vary due to customs processing, local carrier delays, or other factors outside our control.

SECTION 17 — EU AND UK CONSUMER RIGHTS

If you are located in the European Union or the United Kingdom, nothing in these Terms of Service affects your statutory rights as a consumer, including your right to withdraw from an order within 14 days of delivery under the EU Consumer Rights Directive or the UK Consumer Contracts Regulations 2013. Please see our Return and Refund Policy for how to exercise these rights, including the sealed-goods exception that applies to supplements.

Jersey and Guernsey are Crown Dependencies and are not covered by the UK Consumer Contracts Regulations. Our 90-Day Satisfaction Guarantee applies to those destinations.

If any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, that provision shall be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be severed from these Terms.

SECTION 19 — TERMINATION

These Terms of Service are effective unless and until terminated by either you or us. If in our sole judgment you fail to comply with any term of these Terms of Service, we may terminate this agreement at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.

SECTION 20 — GOVERNING LAW

These Terms of Service and any separate agreements under which we provide you services are governed by the laws of the State of Connecticut, United States, without regard to its conflict of law provisions. This does not deprive consumers resident in the European Union or United Kingdom of the protection of mandatory consumer law in their country of residence.

SECTION 21 — CHANGES TO TERMS OF SERVICE

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates to our website. Your continued use of our website or the Service following the posting of changes constitutes acceptance of those changes.

By providing your mobile number, you agree to receive recurring automated marketing and order-related text messages from Pupganics. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to any message to opt out, or HELP for help. Carriers are not liable for delayed or undelivered messages.
