This Privacy Policy describes how Pupganics (the "Site", "we", "us", or "our") collects, uses, and discloses your personal information when you visit, use our services, or make a purchase from Pupganics.com, or otherwise communicate with us (collectively, the "Services"). "You" and "your" means you as a user of the Services, whether you are a customer, website visitor, or another individual whose information we have collected.

WHAT PERSONAL INFORMATION WE COLLECT

We do not intentionally collect sensitive personal information as defined under the California Privacy Rights Act, and we do not use or disclose sensitive personal information for purposes requiring a right to limit.

  • Shopify — powers our store and e-commerce infrastructure, including checkout and payment processing
  • ShipBob — our fulfillment partner, receives your name, shipping address, and order details to ship your orders
  • FlavorCloud — our international shipping partner, processes shipping and customs data for orders delivered outside the United States
  • Loop Subscriptions — our subscription platform, processes subscription preferences, billing schedule, and order history
  • Klaviyo — our email and SMS marketing platform, processes your contact details and engagement data
  • Meta Platforms (Facebook and Instagram) — see the dedicated section below
  • Payment processors — collect payment information to process your transactions

Information we obtain from third parties is treated in accordance with this Privacy Policy.

HOW WE USE YOUR PERSONAL INFORMATION

Providing products and services. To process payments, fulfill orders, manage your subscription, send notifications about your account and purchases, arrange shipping, and handle returns. We may also enable Shopify to match your account with other Shopify services you choose to use. For EEA and UK residents, the legal basis is performance of a contract, Art. 6(1)(b) GDPR.

Marketing and advertising. To send marketing and promotional communications by email, text message, or postal mail, and to show you advertisements on platforms including Meta (Facebook and Instagram). For EEA and UK residents, the legal basis is your consent, Art. 6(1)(a) GDPR, which you may withdraw at any time.

Security and fraud prevention. To detect, investigate, and act on possible fraudulent, illegal, or malicious activity. For EEA and UK residents, the legal basis is our legitimate interest in keeping our website and customers secure, Art. 6(1)(f) GDPR.

Communication and service improvement. To provide customer support and improve our Services. For EEA and UK residents, the legal basis is our legitimate interest in operating and improving our business, Art. 6(1)(f) GDPR.

Legal compliance. To comply with legal obligations, enforce our terms, and protect our rights. For EEA and UK residents, the legal basis is Art. 6(1)(c) GDPR.

ADVERTISING TECHNOLOGY AND THE META PIXEL

We want to be specific about this, because it is the part of online tracking people most often have questions about.

What we use. Our website uses the Meta Pixel, a piece of code provided by Meta Platforms, Inc. We also use Meta's Conversions API, which sends purchase and event information from our servers directly to Meta.

What it collects. These technologies collect information about your activity on our site — pages you view, products you view or add to cart, and purchases you complete — along with your IP address, browser and device information, and cookie identifiers. Where you have provided it, contact information such as your email address may be shared with Meta in hashed (scrambled) form so that Meta can match your activity to an existing account.

Why we use it. To measure whether our advertising works, to show you Pupganics ads on Facebook and Instagram, and to build audiences of people with similar interests.

Who receives it. Meta Platforms, Inc. Meta processes this information under its own terms and privacy policy, and acts as an independent controller for some of it. You can review Meta's practices at facebook.com/privacy/policy and control your ad settings at facebook.com/adpreferences.

Your choices.

  • EEA and UK visitors — we request your consent before placing non-essential cookies or firing advertising tags. You may withdraw consent at any time through our cookie preference center.
  • US visitors — you may opt out of this activity at any time using the "Do Not Sell or Share My Personal Information" link in our website footer, or by emailing help@pupganics.com.
  • Global Privacy Control — we honor the Global Privacy Control (GPC) browser signal as a valid opt-out of sale and sharing for visitors in states that recognize it.
  • Browser controls — you may block or delete cookies through your browser settings. Doing so may affect how parts of our site work.

Sale and sharing. Under California law, the use of advertising technology described above is considered "sharing" of personal information for cross-context behavioral advertising, and may be considered a "sale" under some state privacy laws. We do not sell personal information for money. We do not knowingly sell or share the personal information of anyone under 16.

SMS AND TEXT MESSAGES

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, except for vendors and aggregators that assist us in delivering text messages to you. Message frequency varies. Message and data rates may apply. You can opt out at any time by replying STOP to any message, and you can reply HELP for assistance.

HOW WE DISCLOSE PERSONAL INFORMATION

We may disclose your personal information to:

  • Vendors and service providers who perform services for us, including IT management, payment processing, data analytics, customer support, cloud storage, fulfillment (ShipBob), international shipping and customs (FlavorCloud), subscription management (Loop Subscriptions), and email and SMS marketing (Klaviyo)
  • Business and marketing partners, including Meta, for the advertising purposes described above
  • Third parties where you direct or consent to the disclosure
  • A counterparty in connection with a business transaction such as a merger, acquisition, or bankruptcy
  • Authorities, where required to comply with legal obligations or to protect our rights

Categories disclosed in the past 12 months: identifiers (name, email, phone, IP address, cookie IDs), commercial information (purchase and subscription history), internet activity (browsing and interaction data), and geolocation inferred from IP address.

INTERNATIONAL DATA TRANSFERS

Your personal information may be transferred to, stored, and processed in the United States and in other countries where our service providers operate, including transfers to ShipBob, FlavorCloud, Loop Subscriptions, Klaviyo, Shopify, and Meta.

Where we transfer personal information out of the European Economic Area or the United Kingdom, we rely on recognized transfer mechanisms such as the European Commission's Standard Contractual Clauses, the UK International Data Transfer Addendum, or an adequacy decision.

DATA RETENTION

We keep personal information only as long as necessary for the purposes described in this policy:

  • Order and transaction records — 7 years, to meet tax and accounting obligations
  • Customer account and subscription data — for as long as your account is active, then 3 years after your last interaction
  • Marketing contact data — until you unsubscribe, then up to 2 years to honor your suppression preference
  • Auto-renewal consent records — at least 3 years, or 1 year after your subscription ends, whichever is longer, as required by California law
  • Website and advertising analytics data — up to 26 months
  • Customer support correspondence — 3 years from the date of the last message

Where a longer period is required by law or needed to resolve a dispute or enforce our agreements, we retain the information for that longer period.

THIRD PARTY WEBSITES AND LINKS

Our Site may link to websites or platforms operated by third parties. We do not guarantee and are not responsible for the privacy or security of those sites. Our inclusion of a link does not imply endorsement.

CHILDREN'S DATA

The Services are not intended for children, and we do not knowingly collect personal information from anyone under the age of 13. We do not knowingly sell or share the personal information of anyone under 16. SECURITY AND RETENTION OF YOUR INFORMATION

We maintain administrative, technical, and physical safeguards appropriate to the sensitivity of the personal information we hold. No security measure is perfect or impenetrable, and we cannot guarantee absolute security.

  • Right to Delete — request deletion of personal information we hold about you
  • Right to Correct — request correction of inaccurate personal information

We may need to verify your identity before acting on your request. You may use an authorized agent where the law permits. We will not discriminate against you for exercising any of these rights.
